Key Provisions of the Bill
The amendment revises the process for legal recognition of transgender identity. Applicants will need to apply to the District Magistrate, and the identity certificate will be issued on the recommendation of a designated medical board headed by a Chief Medical Officer or Deputy Chief Medical Officer.
Changes in Official Documents
The Bill allows transgender persons to change their first name in official records, including birth certificates, on the basis of the identity certificate. The provision is intended to simplify the updating of personal details across government records.
Debate Over Self-Identification
The Bill has triggered criticism from opposition parties and LGBTQIA+ activists, who argue that mandatory medical verification conflicts with the principle of self-identification recognised in the Supreme Court's NALSA judgment of 2014.
Government's Position
The government has said that a structured certification system will help ensure better implementation of welfare schemes, improve access to social security and healthcare, and prevent misuse. The Bill will next be taken up in the Rajya Sabha.
