Ninth Schedule of the Indian Constitution: UPSC notes
The Ninth Schedule was introduced by the Constitution (First Amendment) Act, 1951, alongside Article 31B. It was created to protect specified laws, particularly land reform legislation, from challenges based on Fundamental Rights. Its protection is not an unlimited exemption from constitutional review.
Article 31B and land reforms
Article 31B deals with the validity of laws listed in the Ninth Schedule. The original purpose was linked to agrarian reform, but later additions broadened the range of legislation in the schedule.
I.R. Coelho judgment: 2007, not 1999
The nine-judge Supreme Court decision in I.R. Coelho v. State of Tamil Nadu was delivered on 11 January 2007. The 1999 proceeding referred questions to a larger bench.
The Court held that amendments adding laws to the Ninth Schedule on or after 24 April 1973 can be examined for damage to the Constitution's basic structure. Inclusion in the schedule does not give a law unlimited immunity when its effect on protected rights damages that structure.
Why is the Ninth Schedule debated?
The central issue is the balance between legislative reform and constitutional limits. For exam answers, explain both the original land reform purpose and the judicial limits on protection. Avoid stating that all scheduled laws are completely beyond judicial review.
